Military Recruiting - Student Privacy Bill advances to Senate Floor
Dear Friend of FCL,
FCL has been working with Assembly Member Sally Lieber on legislation to prohibit public schools from providing military recruiters with student contact information without the consent of parents and/or students. This legislation now moves to the Senate Floor.
Background
The federal No Child Left Behind Act requires schools to provide military recruiters with access to student records in order to receive federal funding. However, No Child Lefty Behind also allows parents and students to opt out from having pupil contact information provided to military recruiters. The problem is that few parents, students, school administrators or teachers are aware of the opt out provision.
The military also administers the Armed Services Vocational Aptitude Battery test (ASVAB) on public school campuses without disclosing that the test is used for recruiting purposes. Student information collected by the ASVAB is of a highly personal nature. For recruiters, having the ASVAB is the difference between making a cold call as opposed to tailoring calls to students based on the information gathered from the ASVAB.
Moreover, the California Constitution guarantees the right of privacy.
Proposal
Under AB 2994, parents and students will be notified on the Emergency Information Request forms that they have the right to opt out. The forms will allow parents and/or students to designate that their student contact information not be provided to military recruiters. The ASVAB could only be offered on school campuses only with the understanding that it could not be used for recruiting purposes without parental and/or student consent.
