California Set to Execute Person With Brain Damage

Dear FCL Supporter,
Pending a stay of execution, Donald Jay Beardslee is scheduled to be executed by the State of California at 12:01 am, January 19, 2005. Mr. Beardslee’s attorneys have petitioned Governor Schwarzenegger for clemency. A clemency hearing will be held in Sacramento on January 14.
Several circumstances surrounding Beardslee’s conviction warrant clemency:
1) The jury was never made aware of the extent to which his actions were the result of severe brain damage.
2) The jury was not allowed to consider and weigh the sentences imposed on co-defendants who initiated and directed the crimes.
3) The jury’s decision to impose the death penalty was based upon the mistaken belief that Mr. Beardslee would pose a danger if sentenced to life in prison without the possibility of parole. Contrarily, the Department of Corrections indicates that he has been a model prisoner.
WHAT YOU CAN DO:
Please contact Governor Schwarzenegger ASAP and urge him to grant clemency. A copy of FCL’s letter to the governor is included as an attachment to this e-mail which you may use as a sample letter.
