Criminal Justice and Public Safety

AB 1718 (Robert Hertzberg, D., Los Angeles) requires certain peace officers to receive advanced training concrning the special needs of persons with mental illness or developmental disability.

AB 1762 (Antonio Villaigosa, D., Los Angeles) seeks to expand on the experience of jurisdictions that use intensively trained officers to intervene in incidents involving a person who shows signs of acute mental illness.

AB 2447 (Rod Wright, D., Los Angeles) direct a judge, when determining whether to strike a prior conviction under the Three Strikes law, to place great weight in favor of striking a prior conviction if the present conviction is not violent or serious.

AB 2489 (Gloria Romero, D., Los Angeles) directs the Board of Corrections to develop a program to award family violence prevention victim-oriented community policing project grants on acompetitive basis to counties.

AB 2716 (Audie Bock, I., Oakland) establishes a homicide prevention and victim services fund to reduce domestic violence and other forms of violence, and to assist victims. FCL SUPPORTS.

[SB 79 (Tom Hayden, D., Santa Monica) Establishes a task force to review the 3-strikes law and to make recommendations about it.
FCL SUPPORTS. Bill is dead.]

[SB 878 (Tom Hayden, D., Santa Monica) when a defendant is convicted of felony murder, directs the court to determine if a sentence of first degree murder is proportionate, and if not, to impose a sentence for 2nd degree murder. Bill is dead.]

SB 1342 (John Burton, D., San Francisco) gives convicted defendants in crriminal cases the right to request DNA testing on evidence relevant to their conviction if the evidence or technology for testing was not available at the time of trial.

SB 1389 (Kevin Murray, D., Culver City) directs the Calfiornia Highway Patrol to report information pertaining to traffic stops as a means of determining if racial characteristics of the driver are a factor in enforcement activity.
FCL SUPPORTS.

SB 1936 (Adam Schiff, D., Burbank) appropriates $242 million to fund certain police salaries and youth violence prevention programs. FCL SUPPORTS, provided that community based organizations have a fair opportunity to compete for violence prevention program dollars.

Capital Punishment

[AB 1712 (Jim Cunneen, R., Cupertino) has been amended to deal with high technology crime, and no longer affects the death penalty; no longer of interest FCL

[ AB 589 (Bob Margett, R., Arcadia) extended the death penalty to first degree murders where the victim is a peace officer at a state hospital. FCL OPPOSES. Bill is dead.]

AB 2684 (Audie Bock, I., Oakland) requires one-third of the savings in costs to be returned to a city or county when the local entity is able to reduce the cost of implementing a state mandate.
FCL SUPPORTS

AB 2826 (Dennis Cardoza, D., Merced) extends the death penalty to murder accomplished by mutilation or burning of the victim or committed to accomplish sexual acts on the corpse.
FCL OPPOSES. See, April '99 N/L.

[ SB 31 (Steve Peace, D., El Cajon) has been amended to deal with firearms insead of extending application of the death penalty to include first degree murder if the victim is under age 14. The bill is no longer of interest to FCL.]

Imprisonment

AB 725 (Richard Floyd, D., Wilmington) required any prisoner's complaint about medical treatment to be reviewed for "probable cause" before being accepted by the medical quality board.
FCL OPPOSES Dropped by author.]

AB 1799 (Scott Baugh, R., Huntington Beach) permits compensation for false imprisonment at the rate of up to $100 per day
FCL SUPPORTS.

AB 2101 (Carole Migden, D., San Francisco) permits journalists to interview prisoners who consent, and enables prisoners to send confidential communications to journalists, except where such a communication would present a danger to security or public safety. FCL SUPPORTS.

AB 2315 (Kerry Mazzoni, D., Novato) requires presentence reports to include information about how any children of a defendant will be taken care of during a period of incarceration, and establishes a study group to develop a model protocol to address the hazards facing children when their parents are arrested. FCL SUPPORTS.

AB 2316 (Kerry Mazzoni, D., Novato) authorizes a study of women inmates who have children, and of the well-being of these children. FCL SUPPORTS.

AB 2787 (Bill Leonard, R., San Bernardino) authorizes closure of San Quentin Prison and relocation of death row, construction of a special prison for elderly and AIDS prisoners. FCL OPPOSES.

SB 127 (Richard Polanco, D., Los Angeles) Allows more flexibility in the place of parole for prisoners seeking to enrole in a drug treatment program. FCL SUPPORTS in principle.

SB 128 (Richard Polanco, D., Los Angeles) provides for the closure of San Quentin Prison, and transfer of death row to Folsom Prison. FCL OPPOSES.

SB 1117 (John Vasconcellos, D., Santa Clara) revises the objectives of incarceration to enhance public safety, and include prisoner rehabilitation programs. FCL SUPPORTS.

SB 1978 (Tom Hayden, D., Santa Monica) establishes a standard for the award of state contracts for telephone services to prisoners, wards, and their families, so that the objective is to minimize costs to the users, rather than to increase profits to the state.
FCL SUPPORTS.

SB 1987 (John Vasconcellos, D., Santa Clara) to prevent parolee crime, provides for substance abuse treatment as well as job preparation and placements for prisoners prior to and after parole. Appropriates $11.9 million.

AB 788 (Abel Maldonado, D., San Luis Obispo) revises juvenile law objectives to to protect the public, to make each offender accountable to the victim and community, and to assure development of basic living skills that will permit minors to live as law-abiding citizens. FCL SUPPORTS.

AB 1390 (Sally Havice, D., Bellflower) establishes a bullying prevention grant program for students in grades 5 and 6. FCL SUPPORTS .

AB 1738 (Carl Washington, D., Los Angeles) provides for construction of a technical school building in compton. No longer of interest to FCL.

AB 1913 (Tony Cardenes, D., Sylmar) allocates $243 million, half to fund a variety of youth programs and violence prevention activity, and half to fund the COPS program (see SB 1936). FCL SUPPORTS.

AB 2280 (Dean Flores, D., Fresno) establishes a youth violence and gang prevention fund to support community-based crime and violence prevention programs. The programs are to address the factors that contribute to higher risks of criminality or gang membership among some populations. FCL SUPPORTS in principle.

AB 2556 (Robert Hertzberg, D., Van Nuys) establishes a community-based planning process and funding for after school programs for children and youth. The programs are to address the factors that contribute to higher risks of criminality or gang membership during the after-school hours. FCL SUPPORTS.

SB 126 (Richard Polanco, D., Los Angeles) creates the Office of the State Incarcerated Youth Ombudsperson to provide assistance to offenders who are 10 to 21 years of age and who are detained or confined. FCL SUPPORTS.

SB 1542 (Adam Schiff, D., Los Angeles) establishes a boot camp for youth 15 years or older who bring firearms to school. FCL OPPOSES.

SB 1603 (Steve Peace, D., LaMesa) establishes more demanding and more workable requirements for minors who have been taken into custody, and who are released with a written promise to appear for further proceedings.

SB 1831 (Teresa Hughes, D., Inglewood) directs the Department of Justice and Commission on Peace Officer Standards and Training to establish a pilot project utilizing regional community policing institutes to provide comprehensive school safety training for those responsible for school safety and school community violence prevention.

SB 1936 (Adam Schiff, D., Los Angeles) funds $121 million in community based juvenile crime prevention programs. FCL SUPPORTS.

SB 1937 (Adam Schiff, D., Los Angeles) establishes a boot camp for youth 15 years or older who commit certain "zero tolerance" weapons or drug offenses and requires such youth to be committed either to the boot camp or to the Youth Authority. FCL OPPOSES.

SB 2183 (Nell Soto, D., Ontario) expands a program that currently provides trauma and grief intervention to students who are victims of violence, or exposure to violence.

AB 1233 (Dion Aroner, D., Berkeley) counts study hours toward student work eligibility requirements for CalWORKS cash assistance. FCL SUPPORTS.

AB 1255 (Rod Wright, D., Los Angeles) exempts qualified former drug felons from the lifetime ban on cash and food stamp assistance. FCL SUPPORTS.

SB 1421 (Hilda Solis, D., Los Angeles) provides a state earned income tax credit for low-income working families FCL SUPPORTS.

SB 1501 (Don Perata, D., Alameda) regulates the payday loan industry. FCL SUPPORTS.

SB 1984 (Cathy Wright, R., Simi Valley) exempts qualified former drug felons from the lifetime ban on cash and food stamp assistance. FCL SUPPORTS.

Health and Mental Health

AB 16 (Mike Honda, D., San Jose) Improves home health care workers' wages, benefits, and quality of service by creating and funding local home health care authorities. FCL SUPPORTS.

AB 43 (Antonio Villaraigosa, D., Los Angeles)implements a health insurance program for children in low income families. FCL SUPPORTS.

AB 52 (Gil Cedillo, D., Los Angeles) preserves immigrant access to certain state funded health care programs. FCL SUPPORTS.

AB 107 (Wally Knox, D., Los Angeles) provides health care benefits to domestic partners of public employees through PERS. FCL SUPPORTS.

AB 1800 (Helen Thomson, D., Davis) Abbreviates the process for forcing a person with serious mental illness into treatment. FCL OPPOSES.

AB 1863 (Martin Gallegos, D., Los Angeles) Allows medically needy individuals to qualify for MediCal without "spending down" all their assets. FCL SUPPORTS.

AB 1969 (Darrell Steinberg, D., Sacramento) Improves oversight of skilled nursing facilities serving mentally ill patients. FCL SUPPORTS.

AB 1990 (Gloria Romero, D., Monterey Park) Gives domestic partners the right to make medical decisions for each other when one is incapable of informed consents. FCL SUPPORTS.

AB 2018 (Helen Thomson, D., Davis) reduces barriers to prescription of medication for pain management. FCL SUPPORTS.

AB 2034 (Darrell Steinberg, D., Sacramento) Authorizes funding for expansion of community mental health programs. FCL SUPPORTS.

AB 2228 (Dion Aroner, D., Berkeley) Provides mental health, health, and education screening for juvenile offenders. FCL SUPPORTS.

SB 82(John Vasconcellos, D., San Jose) restores prenatal care to undocumented immigrants. FCL SUPPORTS.

SB 89 (Martha Escutia, D., Los Angeles) Requires formation of a state agency working group on environmental justice. FCL SUPPORTS.

SB 92 (Tom Hayden, D., Los Angeles) implements health insurance program for children in low income families. FCL SUPPORTS.

SB 118 (Tom Hayden, D., Los Angeles) Allows employees to take family care and medical leave to care for a person other than a child, spouse or parent. FCL SUPPORTS.

SB 848 (John Vasconcellos, D., San Jose) requires the state to implement a medical marijuana distribution plan. FCL SUPPORTS. (See, SB 1887 of last session.)

SB 1149 (Tom Hayden, D., Los Angeles) allows employees to take family care and medical leave to care for a person other than a child, spouse or parent. FCL SUPPORTS.

SB 1348 (John Vasconcellos, D., Silicon Valley) Requires Youth Authority and school districts to provide parenting education; directs Department of Health Services to develop a master plan for parenting education in nonschool settings. FCL SUPPORTS.

SB 1408 (Richard Alarcon, D., Los Angeles) Creates the Environmental Justice Technical Assistance Grant Demonstration Program. FCL SUPPORTS.

SB 1464 (Ross Johnson, R., Irvine) $20 million budget augmentation for homeless mentally ill programs. FCL SUPPORTS.

SB 1534 (Don Perata, D., Oakland) Expands the mental health patients advocacy program. FCL SUPPORTS.

SB 1622 (Richard Alarcon, D., Los Angeles) Requires that environmental justice issues be considered when siting new power plants. FCL SUPPORTS.

SB 1769 (Wesley Chesbro, D., Arcata) encourages counties to submit crime reduction grant proposals that establish or implement mental health courts. FCL SUPPORTS.

SB 1770 (Wesley Chesbro, D., Arcata) directs the Department of Mental Health to request proposals to establish and expand empowerment programs for mental health clients and their families FCL SUPPORTS.

Immigrants

AB 1197 (Marco Firebaugh, D., East Los Angeles) Allows otherwise qualified immigrants to pay in-state tuition for public higher education. FCL SUPPORTS.

AB 1463 (Gil Cedillo, D., Los Angeles) Allows immigrants to apply for driver's licenses.

AB 2417 (Marco Firebaugh, D., East Los Angeles) Eliminates restrictions on immigrant eligibility for food and cash assistance. FCL SUPPORTS.

Human Services

AB 2417 Marco Firebaugh, D., East Los Angeles) continues the California Food Assistance Program to provide food stamps for immigrants who entered the United States after August 22, 1996. FCL SUPPORTS.

SB 2013 (Senator Martha Escutia, D., Montebello) requires the State Department of Social Services to develop a simplified, shortened application for food stamps, such as Tennessee's two-page application for food stamps, or Texas' bi-lingual, four-page application for food stamps and cash assistance. FCL SUPPORTS.

AB 398 (Carole Migden, D., San Francisco) and SB 510 (Richard Alercon, D., Los Angeles) housing bond measures for seniors, disabled, self-help, rehabilitation, and code enforcement. FCL SUPPORTS.

AB 869 (Fred Keeley, D., Boulder Creek) requires insurers to invest in affordable housing. FCL SUPPORTS.

AB 1811 (Sarah Reyes, D., Fresno) Provides a tax credit for construction of farmworker housing. FCL SUPPORTS. Assembly Rervenue and Taxation Committee.

SB 1545 (Jim Costa, D., Fresno) Strenghtens farmworker labor camp inspections.

SB 1593 (Richard Alarcon, D., Los Angeles) Creates an omnibus Housing and Community Development home ownership program. FCL SUPPORTS.

SB 1745 (John Burton, D., San Francisco) Increases notice to tenants of rent increases and terminations.

Welfare Reform

AB 1098 (Gloria Romero, D., Los Angeles) creates 10,000 new public jobs in high unemployment areas of the state. FCL SUPPORTS.

SB 1421 (Hilda Solis D., El Monte) creates a State Earned Income Tax Credit for low-income working families, providing a maximum of $572 for a qualifying family with two or more children and earnings between $9500 - $12,000 annually. FCL SUPPORTS.

SB 1984 (Cathie Wright, R., Simi Valley), exempts from lifetime disqualification for benefits those persons convicted of felonies involving use or possession of controlled substances who have completed drug treatment or who are currently participating in drug treatment or are willing to undergo treatment; and those for whom five years have elapsed since the conviction; and those who are not currently using a controlled substance. Periodic drug testing is required for those receiving the exemption, and no direct cash benefits would be provided. FCL SUPPORTS.

Peace and Human Rights

AB 2047 (Darrell Steinberg, D., Sacramento) Gives domestic partners inheritance and administrative rights when one dies without a will.
FCL SUPPORTS.

AB 2142 (Fred Keeley, D., Santa Cruz) Prohibits employment and housing discrimination based on actual or perceived gender.
FCL SUPPORTS.

AB 2574 (Mike Briggs, R., Fresno) Requires Department of Motor Vehicles to register young men with the Selective Service System if they are not already registered at the time them apply for a driver's license, unless the applicant specifically declines to be registered. FCL OPPOSES.
