Criminal Justice and Public Safety

AB 1790 (Jackie Goldberg, D., Los Angeles) re-casts the "three-strikes" law to remove manditory minimum sentences if the conviction is for a non-violent felony. FCL SUPPORTS. Died in Assembly.

AB 2171 (Dave Cogdill, R., Modesto) prevents bail from being exonerated if the federal government deports a defendant before the criminal case is concluded. FCL OPPOSES. Died in Assembly.

AB 2211 (Jerome Horton, D., Inglewood) directs the Judicial Council to study the effects, implementation issues, and alternatives to community impact statements as part of the criminal justice process. Chapter 1092.

AB 2282 (Jay LaSuer, R., La Mesa) restricts the funding of drug rehabilitation programs to non-urban areas. FCL OPPOSES. Died in Assembly.

AB 2652 (Judy Chu, D., Monterey Park) establishes a domestic violence court task force. FCL SUPPORTS. Vetoed.

AB 2910 (Dario Frommer, D., Los Angeles) allows the Director of Mental Health to determine who is a sexually violent predator and to petition to extend their committment independent of the recommendations by mental health evaluators. FCL OPPOSES. Died in Assembly.

SB 27 (Bruce McPherson R., Santa Cruz) ) establishes emergency response training programs on terrorism awareness and response. FCL OPPOSES unless amended to address prevention and issues affecting the recruitment of people into political violence. Died in Assembly.

SB 1350 (Bruce McPherson R., Santa Cruz) establishes an Emergency Response Training Advisory Committee to develop training programs on terrorism awareness and response together with the State Fire Marshall and the Commission on Peace Officer Standards and Training. FCL OPPOSES unless amended to address prevention, and issues affecting the recruitment of people into political violence. Chapter 612.

SB 1517 (Richard Polanco, D., Los Angeles) provides that persons convicted of forgery, receiving stolen property and other non-violent felony offenses are not subject to "three-strikes" sentences. FCL SUPPORTS. Died in Senate.

SB 1719 (Byron Sher, D., Palo Alto) converts felony shoplifting and petty theft with a prior into misdemeanor offenses, so as to prevent minimum 25-year sentences to state prison from being applied in such cases. FCL SUPPORTS. Died in Senate.

SB 1722 (Martha Escutia, D., Whittier) requires police reports of domestic violence to identify children who were likely to have witnessed the violence, and makes them eligible for public services. FCL SUPPORTS. Died in Assembly.

SB 1807 (Wesley Chesbro, D., Arcata) lowers the burden of proof to prevent the return of a deadly weapon seized during a domestic violence arrest.FCL SUPPORTS. Chapter 833.

Capital Punishment

AB 557 (Dion Aroner, D., Berkeley) establishes a procedure for court hearings to implement the United States Supreme Court decision in the Adkins case that prohibits the state from executing persons who are mentally retarded. [See also, AB 1512 (Aroner) which was a 2001 effort on the same issue] FCL SUPPORTS. Died in Assembly.

AB 2103 (Phillip Wyman, R., Tehachapi) expands the death penalty to apply to a case where a defendant kills a person while committing a terrorist act. FCL OPPOSES. Died in Assembly.

AB 2710 (Phillip Wyman, R., Tehachapi) expands the death penalty to apply to a case where a defendant kills a person under age 14. FCL OPPOSES. Died in Assembly.

Imprisonment

AB 310 (Jackie Goldberg, D., Los Angeles) allows the Board of Prison Terms to order initial or continued participation in reintegration programs for female parole violators in lieu of having their parole revoked provided that the parole violation was nonviolent. FCL SUPPORTS. Chapter 619.

AB 2375 (Gloria Negrete McLeod, D., Palos Verde) requires that women sentenced to prison are formally notified of the Community Mother Prisoner Program and that their children have access to available Healthy Start and Head Start programs. FCL SUPPORTS. Died in Senate.

AB 2905 (Roderick Wright, D., South Central Los Angeles) requires the Dept. of Corrections to offer HIV testing and HIV prevention education to all inmates. FCL SUPPORTS. Vetoed.

SB 988 (Richard Polanco, D., Los Angeles) requires all new prison facilities to accommodate a therapeutic community drug treatment program for at least half of all inmates. FCL SUPPORTS. Died in Senate Public Safety.

SB 1496 (Richard Polanco, D., Los Angeles) as amended at the close of session, addresses the farm labor issue and did not pass. Originally, the bill made findings that public safety is enhanced by programs that prepare prisoners for release before they are paroled, and expands elegibility for placement in correctional reentry centers, and FCL was in support.

SB 1497 (Richard Polanco, D., Los Angeles) establishes a process for review of life sentences by a panel of three judges in cases where a prisoner has served more time in prison than is suggested by the matrix used by the Board of Prison Terms. FCL SUPPORTS. Died in Assembly.

SB 2002 and SCA 15 (John Vasconcellos, D., San Jose) establishes public safety as the purpose of incarceration, and require measures to improve parole success. FCL SUPPORTS. Died in Senate.

Children and Youth

AB 1877 (Abel Maldonado, D., San Luis Obispo) amended to permit another agency to use the facilities constructed for the Turning Point Acadamy. No longer of concern to FCL.

AB 1984 (Darrell Steinberg, D., Sacramento) and SB 1478 (Bruce McPherson, R., Santa Cruz) would encourage development of after-school programs on high school campuses. FCL SUPPORTS. Chapters 1025 and 1036 respectively.

AB 2462 (Patricia Bates, R., Laguna Niguel) ensures that children from homes where crimes of domestic violence have occurred are eligible for assistance under the Victims of Crime Program. FCL SUPPORTS. Chapter 479.

AB 2496 (Darrell Steinberg, D., Sacramento) seeks to hasten compliance with court orders for placement of youths in group homes or foster care, following detention in juvenile hall. FCL SUPPORTS. Vetoed.

AB 2730 (Carl Washington, D., Los Angeles) establishes a Youth Mentoring and Safe Communities Grant Program to be located in public libraries, and appropriates $400,000 to fund the services. FCL SUPPORTS. Died in Senate.

SB 1362 (Betty Karnette, D., Lng Beach) establishes pilot programs to permit the children of women serving life terms in prison to have overnight visits with their mothers, even though no parole date has been set. FCL SUPPORTS. Vetoed.

SB 1667 (John Vasconcellos, D., Santa Clara) directs schools to include all aspects of violence prevention in safety and violence prevention plans. FCL SUPPORTS. Chapter 506.

SB 1979 (Jim Costa, D., Fresno) would extend for two years the California National Guard's "Turning-point Acadamy" with a budgeted cost of $3 million, and permits admission of youth who have committed a variety of offenses on the school grounds or at school sponsored events.
FCL OPPOSES. Failed in Senate.

Budget and Revenue

AB 1753 (Carole Migden, D., San Francisco) amended to address magazine renewals. No longer of concern to FCL.

SB 1255 (John Burton, D., San Francisco) restores the "top bracket" state income tax rates that were deleted in 1996 until the Director of Finance certifies that the prudent reserve threshold has been met. FCL SUPPORTS. Died in Senate.

Health and Mental Health

AB 1421 (Helen Thomson, D., Davis) establishes a pilot program for intensive assisted outpatient mental health treatment of individuals who have twice been treated in jail or prison for a mental illness, or who are a danger to self or others, and are at high risk for poor outcomes, under court supervision. Chapter 1017.

AB 1422 (Helen Thomson, D., Davis) establishes a mental health advocacy commission composed of 11 members, to serve until 2008. FCL SUPPORTS. Vetoed.

AB 1806 (Keith Richman, R., Granada Hills) requires the department of Health to exercise its option under the federal Social Security Act to expand eligibility for Medi-Cal by maximizing the resources that medically needy individuals may retain for purposes of Medi-Cal eligibility, to the extent that federal financial participation is available. FCL SUPPORTS. Died in Senate.

AB 2739 (Wilma Chan, D., Oakland) requires Medi-Cal managed care plans to provide culturally and linguistically appropriate services.
FCL SUPPORTS. Vetoed.

AB 2740 (Wilma Chan, D., Oakland) requires the development of a state mental health plan for children, as suggested by the Little Hoover Commission. FCL SUPPORTS. Vetoed.

SB 187 (John Vasconcellos, D., Santa Clara) directs the State Department of Health to establish a voluntary system for issuance of identification cards to qualified patients who use marijuana for medical purposes, and for primary caregivers. FCL SUPPORTS. Died in Senate.

SB 599 (Wesley Chesbro, D., Napa) provides that insurers will cover drug and alcohol addictions on the same basis as other medical conditions. FCL SUPPORTS. Died in Assembly

SB 931 (John Burton, D., San Francisco) provides for grants to expanding comprehensive treatment services to persons with mental illness at risk of involuntary commitment under the Lanterman-Petris-Short Act, and requires development of training program to improve for delivery of services under this bill. FCL SUPPORTS. Died in Assembly

SB 1911 (Debra Ortiz, D., Sacramento) establishes a Department of Mental Health task force to study barriers to mental health for children that are privately insured. FCL SUPPORTS. Chatper 817.

SB 1734 (John Vasconcellos, D., Santa Clara) extends existing immunity from prosecution for distributing clean syringe and needle exchange programs and specifies that immunity be pursuant to an annual declaration of a local health crisis. FCL SUPPORTS. Governor's Desk.

Housing

AB 1866 (Rod Wright, D., Los Angeles) seeks to increase the number of affordable housing units by making more housing developments eligible for certain fiscal incentives under the density bonus law, and by enabling homeowners to shortcut the approval process for creating "granny flats" and other second units on their property. FCL SUPPORTS. Chapter 1062.

AB 2292 (John Dutra, D., Fremont) prevents local governments from imposing density reductions that are inconsistent with established zoning standards, and provides developers with a remedy for illegally imposed restrictions. FCL SUPPORTS. Chapter 706.

SB 372 (Joseph Dunn, D., Garden Grove) creates a short-term capital loan program to permit preservation of affordable housing developments and allow time for a permanent preservation strategy to be implemented. The bill also creates the Preservation Opportunity Fund to facilitate appropriations to these programs. FCL SUPPORTS. Chapter 721.

SB 1227 (John Burton, D., San Francisco) enacts the Housing Bond Act of 2002, which will authorize the issuance of a $2 billion general obligation bond issue for state housing programs.
FCL SUPPORTS. Chaptered, Prop 46.

SB 1403 (Sheila Kuehl, D., Santa Monica) applies the 60-day no-fault eviction notice that now applies in a few cities throughout the state, and enacts other tenant protections. FCL SUPPORTS. Chapter 301.

Immigrants

AB 60 (Gill Cedillo, D., Los Angeles) allows a person who does not have a social security number or who is in the process of obtaining lawful immigration status to obtain a driver's license or identification card for up to three years. FCL SUPPORTS. Vetoed.

Low-income Californians

AB 989 (Wilma Chan, D., Oakland) originally affected food stamp elegibility, but as amended at the close of the session, this bill excludes holocaust restitution payments from personal income taxes and for purposes of determining elgibility for state education grants, state disability benefits, program enrollments and public services. Chapter 701.

SB 1736 (John Burton, D., San Francisco) provides for mediation of certain contract negotiations involving agricultural labor. FCL SUPPORTS. Vetoed. Compromise bills AB 2596 (Herb Wesson, D., Culver City) and SB 1156 (John Burton, D., San Francisco) were both chaptered.

Peace and Human Rights

AB 1649 (JackieGoldberg, D., Los Angeles) prohibits employment and housing discrimination based on actual or perceived gender. FCL SUPPORTS. Died in Senate.

SB 1276 (Jackie Speier, D., San Mateo) as amended, directs the Department of Motor Vehicles to offer men under age 26 the opportunity to register with the Selective Service system automatically, when they apply for a drivers license. FCL OPPOSES. Died in Senate.

SJR 32 (Ray Haynes, R., Riverside) congratulates the Bush Administration for its strategies in fighting terrorism." FCL OPPOSES. Died in Assembly.

SJR 33 (Ray Haynes, R., Riverside) urges congress and the administration to develop missile defense systems. FCL OPPOSES. Died in Senate.
