Criminal Justice and Public Safety
SB 78 (Kevin Murray, D., Culver City) ('driving while black') requires statistics to be kept on motor vehicle stops based on racial characteristics. FCL SUPPORTS. Vetoed
SB 79 (Tom Hayden, D., Santa Monica) applies the 3-strikes law to serious and violent felonies only. FCL SUPPORTS.
SB 873 (John Vasconcellos, D., Sant Clara) directs the legislative analyst to report on the effects of the 3-strikes law. FCL SUPPORTS. Vetoed
SB 878 (Tom Hayden, D., Santa Monica) when a defendant is convicted of felony murder, directs the court to determine if a sentence of first degree murder is proportionate, and if not, to impose a sentence for 2nd degree murder.

Capital Punishment
Several measures were introduced in the Assembly to expand the death penalty:
AB 3 (Roy Ashburn, R., Bakersfield) died in Assembly Public Safety Committee. AB 4 (Steve Baldwin, R., El Cajon). would add a new special circumstance to permit the death penalty if the murder victim is under age 14. FCL OPPOSED. See, April '98 N/L.
AB 35 (Tony Strickland, R., Oxnard) extends application of the death penalty to commission of second offenses of rape or child molestation. FCL OPPOSES.
AB 54 (Jim Battin, R., LaQuinta) extends the death penalty to capital offenses where the offender is 16 or 17 years of age years of age. FCL OPPOSES. Died in Assembly Public Safety Committee.
371 (Sally Havice, D., Artesia) extends the death penalty to first degree murders where two or more attempted murders accompany the killing. FCL OPPOSES.
AB 589 (Bob Margett, R., Arcadia) extends the death penalty to first degree murders where the victim is a peace officer at a state hospital. FCL OPPOSES.
AB 1184 (Charlene Zettel, R., Poway) extends the death penalty to first degree murders where the victim was protected under a restraining order. FCL OPPOSES.

Imprisonment
SB 12 (Richard Rainey, R., Walnut Creek) increases required training for new correctional officers. FCL SUPPORTS, with amendments to also provide added in-service training.
SB 13 (Richard Rainey, R., Walnut Creek) permits revocation of parole prior to the release of a prisoner who has a mental disorder if behavior in the 90 days prior to release indicates likelyhood that a crime may be committed by the person. FCL OPPOSES, unles amended to provide adequate mental health services during their term of imprisonment to inmates who are likely to fall into this category.
SB 126 (Richard Polanco, D., Los Angeles) Revises the Statutory declaration on the purpose of imprisonment. FCL SUPPORTS, with amendments to also provide that the over-arching purpose of prison is to promote public safety.
[ SB 175 (Richard Rainey, R., Walnut Creek) as amended, establises a pilot project to process un-served warrants. No longer of interest to FCL.]
SB 659 (Cathie Wright, R., Simi Valley) directs the State Department of Social Services to establish a task force on the effects of incarcerating parents for drug offenses. FCL SUPPORTS. Vetoed.
SB 904 (Jim Costa, D., Fresno) authorizes new prison construction at Delano, financed by espensive revenue bonds. FCL OPPOSES. (See the 1995 Legislative Analyst's Report on uses and costs of lease-purchase bonds: http://www.lao.ca.gov/sc050395.html on the internet.)
SB 994 (Debra Bowen, D., Marina Del Rey) encourages addicted felons to participate in the CDC civil committment program. FCL SUPPORTS. Vetoed.
AB 326 (Bill Leonard, R., Upland) authorizes bonds to fund six new prisons. FCL OPPOSES.
AB 369 (Sally Havice, D., Cerritos) being amended to ban "conjugal" visits for prisoners convicted of offenses which are classified as "violent." FCL OPPOSES.
AB 798 (Scott Wildman, D., Los Angeles) increases funding for prisoner education. FCL SUPPORTS. Vetoed.
AB 1440 (Carole Migden, D., San Francisco) authorizes press contact with prisoners. FCL SUPPORTS. Vetoed.

Juveniles and Youth
SB 306 (Tom Hayden, D., Los Angeles) funds the Parent Involvement Grant Program through nonprofit community-based organizations to allow those organizations to offer training courses for parents of schoolage children to enhance involvement in the public schools. FCL SUPPORTS.
SB 323 (Tom Hayden, D., Los Angeles) establishs a task force to involve youth in making recommendations regarding gang violence prevention, and to promote efforts to create a peace process involving gang members both in and out of prisons. FCL SUPPORTS. Vetoed.
SB 334 (Deirdre Alpert, D., Coronado) establishs a "no more victims violence prevention 2000 strategy" with some $70 million in school safety and violence prevention funding, but also permits direct filing of certain serious allegations against youth in the adult court. FCL OPPOSES unless amended to delete the direct filing provision. Chapter 996.

Civil Rights
SB 38 (Joe Baca, D., San Bernardino) a spot bill to codify provisions of the California Constitution and the judicial process respecting free exercise of religion respecting zoning and land use. FCL SUPPORTS See, March '98 N/L article.
SB 1266 (Pete Knight, R., Palmdale) encourages high schools to designate a Selective Service registrar to assist students in registering for the draft. FCL OPPOSES. Chapter 189.
AB 1001 (Antonio Villaraigosa, D., Los Angeles) establishes sexual orientation as an unlawful basis for discrimination in housing and employment. FCL SUPPORTS. Chapter 592.
AB 1436 (Mike Briggs, R., Fresno) prohibits state agencies and state universities from employing men between ages 18 and 26 who are not registered with the Selective Service. FCL OPPOSES.

Health and Mental Health
SB 305 (John Vasconcellos, D., San Jose) extends parenting education programs to youth correctional facilities. FCL SUPPORTS. (See SB 2138 of last session.) Vetoed.
SB 480 (Hilda Solis, D., El Monte) provides for universal health coverage for California residents, effective in 2003. FCL SUPPORTS. Chapter 990.
AB 34 (Darrell Steinberg, D., Sacramento) improves local mental health services. FCL SUPPORTS. Chapter 617.
AB 52 (Gil Cedillo, D., Los Angeles) preserves immigrant access to certain state funded health care programs. FCL SUPPORTS.
AB 88 (Helen Thomson, D., Woodland) requires insurers to include treatment of mental illness in health coverage. FCL SUPPORTS. Chapter 534.

SB 659 (Cathie Wright, R., Simi Vally) establishes a task force on denial of assistance to drug felons after release from prison. FCL SUPPORTS. Vetoed.
AB 873 (Antonio Villaraigosa, D., Los Angeles) removes the sunset on food stamps for immigrants and disabled residents not covered due to federal welfare changes. FCL SUPPORTS. Chapter 493.

SB 633(Byron Sher, D., Palo Alto) provides capital funds for acquisition, construction and rehabilitation of homeless shelters to diminish use of National Guard Armories. FCL SUPPORTS.
SB 781(Jackie Speier, D., Hillsborough) provides rental assistance to families transitioning from welfare to work in high-living-cost counties. FCL SUPPORTS. Vetoed.
SB 948(Richard Alercon, D., Los Angeles) adjusts land use and planning law to preserve and expand affordable housing supply. FCL SUPPORTS. Chapter 968.
AB 34 (Darrell Steinberg, D., Sacramento) expansion grants to counties for counseling, housing assistance, and vocational services to mentally ill. FCL SUPPORTS. Chapter 617.
AB 97 (Tom Torlakson, D., Antioch) increases state tax credit for low income housing. FCL SUPPORTS. Chapter 893.
AB 1505 (Denise Moreno, D., San Diego) expands allowable units of farmworker housing on rural lands, and stops communities from using state environmental codes to block construction of farmworker housing. FCL SUPPORTS. Chapter 967.
AB 1580 (Dean Flores, D., Fresno) requires Department of Housing and Community Development to establish a task force and devise a strategy to improve farm worker housing. FCL SUPPORTS.
Welfare Reform
AB 1039 (Dion Aroner, D., Berkeley) CalWORKS clean-up bill. Counts study time toward work participation requirements for self-initiated students; requires notice and appeal when students are referred to other activities; sets standards for wage-based employment as community service; expands child support assurance demonstration projects. FCL SUPPORTS. Vetoed.
